{"id":128721,"date":"2019-04-08T04:48:39","date_gmt":"2019-04-08T04:48:39","guid":{"rendered":"https:\/\/news.iium.edu.my\/?p=128721"},"modified":"2019-04-08T04:48:41","modified_gmt":"2019-04-08T04:48:41","slug":"how-new-malaysia-deals-with-child-marriage-issue","status":"publish","type":"post","link":"https:\/\/news.iium.edu.my\/?p=128721","title":{"rendered":"How new Malaysia deals with child marriage issue"},"content":{"rendered":"\n<p><em><strong>By Mahadhir bin Monihuldn<\/strong><\/em><\/p>\n\n\n\n<p>It was just recently that the Malaysian\npublic was outraged by news of a 41-year-old man from Gua Musang, Kelantan,\nmarrying an 11-year-old girl in Thailand as his third wife.<\/p>\n\n\n\n<p>Another incident of child marriage was that\nof a 15-year-old girl from Tumpat, Kelantan who was married away to a man three\ntimes older than her at age 44.<\/p>\n\n\n\n<p>Child marriage\u201ddefined as the formal or informal marriage of a girl or a boy before the age of 18\u201dis indeed a problem that the new government of Malaysia has to put their minds to.<\/p>\n\n\n\n<p>Deputy Women, Family, and Community\nDevelopment Minister Hannah Yeoh in late July 2018 announced that 14,999 child\nmarriages were recorded between 2007 and 2017. Statistics pointed to Sarawak\nhaving the highest number of registered child marriages.<\/p>\n\n\n\n<p>This is one too many vulnerable child brides being locked away in marriages with men who are often dubious in character.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/111-1.jpg\" alt=\"\" class=\"wp-image-128725\" width=\"247\" height=\"165\" srcset=\"https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/111-1.jpg 1000w, https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/111-1-300x202.jpg 300w, https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/111-1-768x516.jpg 768w\" sizes=\"(max-width: 247px) 100vw, 247px\" \/><\/figure><\/div>\n\n\n\n<p>The harms that child marriage give to a\nchild are immense. Child marriage cuts off girls access to health care,\neducation and work opportunities. It renders them more likely to become victims\nof domestic violence. They are at higher risk of dying from pregnancy and\nchildbirth complications as they are still physically immature. And because\nthey are psychologically unprepared to become mothers, the children of child\nbrides will also have to bear the cost.<\/p>\n\n\n\n<p>Yet, to assume that the issue is a simple problem is akin to undermining it altogether. Child marriage is a complex issue interweaving economic and cultural forces. <\/p>\n\n\n\n<p>Statistics from the Girls Not Brides organisation show that more than half of girls from the poorest families in the developing world are married as children. Where poverty is extreme, families and sometimes girls themselves believe that marriage will be a solution to secure their future.<\/p>\n\n\n\n<p>Thus, giving a daughter in marriage allows\nparents to reduce family expenses by ensuring they have one less person to\nfeed, clothe and educate.<\/p>\n\n\n\n<p>Child marriage is also driven by\npatriarchal values and the desire to control female sexuality such as how a\ngirl should behave, how she should dress, who she should be allowed to see, to\nmarry, etc. <\/p>\n\n\n\n<p>Another reason is that some social groups believe\nchild brides are already fit and ready to become wives to men. In some\ncommunities, when girls start to menstruate, they become women in the eyes of\nthe community. Marriage is therefore the next step towards giving a girl her\nstatus as a wife and mother. <\/p>\n\n\n\n<p>With all these factors behind the\nphenomenon of child marriage, we must ask this question: What actions have the\nnew Malaysian government taken to address the issue?<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/222.jpg\" alt=\"\" class=\"wp-image-128723\" width=\"262\" height=\"190\" srcset=\"https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/222.jpg 620w, https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/222-300x217.jpg 300w\" sizes=\"(max-width: 262px) 100vw, 262px\" \/><\/figure><\/div>\n\n\n\n<p>Malaysias civil law sets 18 as the minimum\nmarriage age for both genders but a provision allows girls to marry at 16 with\nthe permission of the court or respective state minister.<\/p>\n\n\n\n<p>This law is overlapped by the countrys\nIslamic Syariah law, which sets 16 years as the minimum age for girls to wed\nand even earlier, with the approval of the Syariah court.<\/p>\n\n\n\n<p>After the Pakatan Harapan government won the elections last year, Prime Minister Tun Dr. Mahathir Mohamad issued a directive ordering all state governments in Malaysia to raise the legal minimum marriage age to 18 years for Muslims and non-Muslims.<\/p>\n\n\n\n<p>However, government officials said it was\nup to the individual states to officially process the directive.<\/p>\n\n\n\n<p>Deputy Women, Family and Community Development Minister Hannah Yeoh, in an interview with radio station BFM, outlined the challenges the government was facing in dealing with the issue.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/333-1024x535.jpg\" alt=\"\" class=\"wp-image-128724\" width=\"333\" height=\"174\" srcset=\"https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/333-1024x535.jpg 1024w, https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/333-300x157.jpg 300w, https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/333-768x401.jpg 768w, https:\/\/news.iium.edu.my\/wp-content\/uploads\/2019\/04\/333.jpg 1200w\" sizes=\"(max-width: 333px) 100vw, 333px\" \/><\/figure><\/div>\n\n\n\n<p>For Muslims, Yeoh said the Ministry had engaged the Conference of Rulers but some states were not agreeable to raising the minimum age of marriage from 16 to 18.<\/p>\n\n\n\n<p>&#8220;A lot of them feel that this (current\nregulation) is sufficient at the moment and they just want to tighten on the\nstandard operating procedure,&#8221; she said.<\/p>\n\n\n\n<p>As of now, only Selangor, which has\nreceived consent from its ruler, has amended its state laws to implement\nstricter conditions for those under the age of 18 who want to get married.<\/p>\n\n\n\n<p>On the other hand, the states of Sabah and\nPenang have agreed to raise the legal minimum marriage age to 18 and will look\nto make it official during their respective state assembly meeting this year.<\/p>\n\n\n\n<p>The government also looks to propose\nstricter standard operating procedures (SOP) in regards to child marriage and\nthe cases heard before the Syariah court judges.<\/p>\n\n\n\n<p>Deputy Minister in the Prime Ministers\nDepartment Fuziah Salleh said, \u0153Applicants of child marriage will need to go\nthrough psychological tests, their parents will be interviewed and there is\nalso a need to look at the mental and physical condition of the child as those\nwho are too young will not be able to shoulder the responsibility.\u009d<\/p>\n\n\n\n<p>\u0153It will also require doctors medical\nreport and so on and this strict SOP aims at protecting the well-being of these\nchildren,\u009d she added.<\/p>\n\n\n\n<p>Ultimately, it will still take time for us\nto properly evaluate the new governments handling of the issue of child\nmarriage as a consensus to amend the laws on marriage has to be made on the\nstate level first.<\/p>\n\n\n\n<p>But United Nations Children Fund (UNICEF) senior child protection specialist Sarah Norton-Staal said she felt encouraged by the Prime Ministers statement on raising the legal minimum age for marriage to 18.<\/p>\n\n\n\n<p>As reported by Malay Mail, Sarah shared: \u0153Although Pakatan Harapan had promised in its election manifesto to raise the minimum legal age for marriage to 18, instructions coming from the highest level of authority gives weight to this issue.\u009d ***<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Mahadhir bin Monihuldn It was just recently that the Malaysian public was outraged by news of a 41-year-old man from Gua Musang, Kelantan, marrying&hellip;
